Welcome to Bite! These Terms & Conditions ("Terms") govern your use of the Bite app ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Account Registration

To use certain features of the Service, you may be required to register an account. You must provide accurate and complete information during the registration process and keep your account information updated.

4. User Responsibilities

When using the Service, you agree to:

  • Maintain Confidentiality: Keep your account login information secure and confidential. You are responsible for all activities that occur under your account.

5. Content Guidelines

You are responsible for any content you upload, post, or otherwise make available on the Service ("User Content"). By posting User Content, you grant Bite a non-exclusive, royalty-free, worldwide, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, and display such content in connection with the Service.

You agree not to post or transmit content that:

  • Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

  • Violates the rights of others, including intellectual property rights and privacy rights.

  • Contains viruses, malware, or any other harmful code.

Bite reserves the right to remove or modify any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Bite and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Bite.

7. Prohibited Activities

You agree not to:

  • Use the Service for any commercial purpose without our express written consent.

  • Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service.

  • Interfere with or disrupt the Service, servers, or networks connected to the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which can be found under biteapp.xyz/policies/privacy-policy. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

9. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Bite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.

  • Any conduct or content of any third party on the Service.

  • Any content obtained from the Service.

  • Unauthorized access, use, or alteration of your transmissions or content.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Bite makes no warranties, expressed or implied, regarding the Service's operation or the information, content, or materials included therein. To the fullest extent permissible under applicable law, Bite disclaims all warranties, expressed or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

12. Governing Law

16. Lunch Lottery

Lunch Lottery is a promotional feature of the Bite app where users can enter for a chance to win €10. By participating in the Lunch Lottery, you agree to the following terms:

  • How to Enter: To enter the Lunch Lottery, you must post content on the Bite app.

  • Winner Selection: One winner is selected per day at random from the eligible entries.

  • Prize: The daily prize is €10.

  • Prize Redemption: To redeem the prize, the winner must:

    • Post about their restaurant visit on the Bite app.

    • Send their bank information to Bite for the transfer of the prize.

Note: Prizes must be claimed within 7 days of winning. Bite reserves the right to verify the authenticity of posts and the eligibility of winners.

17. End-User License Agreement (EULA)

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Bite ("Licensor") governing your use of the Bite app ("Licensed Application"). By installing, accessing, or using the Licensed Application, you agree to be bound by the terms of this Agreement.

License Grant

Bite grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on devices that you own or control, strictly in accordance with the terms of this Agreement.

License Restrictions

You agree not to:

  • Copy, modify, or distribute the Licensed Application for any purpose without Bite's express written permission.

  • Reverse engineer, decompile, or disassemble the Licensed Application.

  • Use the Licensed Application in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this Agreement.

Ownership

The Licensed Application is licensed, not sold. Bite retains all right, title, and interest in and to the Licensed Application, including all intellectual property rights therein.

Termination

This Agreement is effective until terminated by either party. Your rights under this Agreement will terminate automatically if you violate any of the terms. Upon termination, you must cease all use of the Licensed Application and uninstall it from your devices.

Updates

Bite may provide updates to the Licensed Application that must be installed for continued use of the Service. By using the Licensed Application, you agree to install such updates as they become available.

No Warranty

The Licensed Application is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied. To the maximum extent permitted by law, Bite disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the fullest extent permitted by applicable law, Bite shall not be liable for any damages arising out of or related to your use or inability to use the Licensed Application.
